1. About these terms

These Terms of Service ("Terms") govern your access to and use of the MCPForm.io website at www.mcpform.io and the content on it (the "Site"). MCPForm.io is a product of Talitu Ltd, a company registered in England and Wales under company number 10295016, with registered office at 483 Green Lanes, London N13 4BS ("MCPForm.io", "we", "us", "our").

By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

2. Using the MCPForm.io product

These Terms cover the Site only. Your use of the MCPForm.io product (the dashboard at app.mcpform.io, the MCP server, the API, the CLI and hosted forms) is governed by the product terms you accept at sign-up and, for organisations, any signed agreement with us. These Terms do not replace them. If these Terms and the product terms disagree about the product, the product terms win.

Nothing on this Site is an offer to provide the product on any particular terms.

3. Who these terms are for

These Terms apply to everyone who uses the Site. You must be at least 18 years old to use it. If you use the Site on behalf of an organisation, you confirm you have authority to accept these Terms for that organisation.

Where you have statutory rights as a consumer that cannot be excluded or limited, nothing in these Terms affects them.

4. Using the site

We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Site for your own information and to learn about MCPForm.io. That right does not include any right to copy, resell, scrape, reverse engineer, republish or create derivative works from the Site or its content, except as the law allows or as we agree in writing.

We may change, suspend or withdraw any part of the Site at any time. We do not promise that the Site will always be available or free of errors.

Some features may ask you to submit information. You are responsible for the accuracy of what you submit. Accounts for the product are created at app.mcpform.io and are covered by the product terms.

5. Examples and interactive tools

The Site may show example forms, calculators, quizzes and other interactive tools. These are provided to show how the product works and for evaluation only.

Example results are illustrations. Do not rely on them. They do not give legal, financial, tax, medical or other regulated advice, and nothing they show forms a quote, an offer or a commitment by us.

Do not enter confidential information, personal data about other people, payment card details, account credentials or anything sensitive into an example or any other tool on the Site. Our Privacy Policy explains how we handle what you do submit.

Forms that customers build with MCPForm.io and publish on their own addresses (for example at mcpforms.io) belong to those customers. The customer who publishes a form is responsible for its content and for how it uses the answers it collects.

6. Enquiries and sign-up

Where the Site lets you send an enquiry, join a waiting list or subscribe to updates, you agree to give accurate details. We may use the information you submit to respond to you.

Sending an enquiry does not create any obligation on either of us, and it does not create a contract for the product.

Some of this may be handled through third-party providers, whose own terms and privacy notices apply to your use of them.

7. Acceptable use

You must not misuse the Site. Prohibited conduct is set out in our Acceptable Use Policy, which forms part of these Terms. In particular you must not attempt to gain unauthorised access to the Site or any connected system, interfere with its operation, introduce malicious code, or use automated means to extract content at scale. You can report abuse to abuse@mcpform.io.

8. Website content and intellectual property

The Site, its content, design, code, the MCPForm.io name and the MCPForm.io branding are owned by or licensed to Talitu Ltd and are protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.

You may view, download and print pages of the Site for your own internal reference, as long as you do not remove any notices and do not use the content for commercial purposes without our written permission.

Feedback. If you send us ideas, suggestions or feedback about the Site or the product, we may use them freely to improve what we do, with no obligation or payment to you. Feedback is given "as is".

9. Links and third-party services

The Site links to and relies on third-party services, which may include analytics, hosting, bot checks and social platforms. We do not control them and are not responsible for their content, availability, terms or practices. Their terms and privacy notices apply to you separately. A link is not an endorsement.

The current list of providers that process personal data on our behalf is at www.mcpform.io/sub-processors.

10. Disclaimers

The Site is provided "as is" and "as available". To the fullest extent permitted by law we exclude all warranties, conditions and representations not expressly stated in these Terms, including any implied warranty of satisfactory quality, fitness for a particular purpose or non-infringement. We do not warrant that the Site will be uninterrupted, error free or secure.

Content on the Site is general information about MCPForm.io. It is not advice, it may change, and it should not be relied on as the basis for any decision. Any examples or features described are illustrative and are not commitments. What the product does, and on what terms, is set out only in the product terms and any signed agreement.

11. Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Subject to that, and to the fullest extent permitted by law, we are not liable for any loss of profits, revenue, goodwill, data or business, or for any indirect or consequential loss, arising from your use of the Site or your reliance on anything on it. Our total liability to you in connection with the Site is limited to £100.

This section applies to the Site only. Liability for the product is dealt with in the product terms and any signed agreement.

12. Privacy and cookies

How we handle personal data is set out in our Privacy Policy. How we use cookies and similar technologies, and how you control them, is set out in our Cookie Policy.

13. Suspending access

We may restrict or block your access to the Site, with notice where reasonable, if you breach these Terms or the Acceptable Use Policy, if the law requires it, or to protect the Site or other users.

14. Changes to these terms

We may update these Terms from time to time. The "last updated" date shows when the current version took effect. Continuing to use the Site after a change means you accept the updated Terms.

15. General

Whole agreement. These Terms, together with the Acceptable Use Policy, the Privacy Policy and the Cookie Policy, are the whole agreement between us about your use of the Site. They do not cover your use of the product.

Severability. If any part of these Terms is found invalid or unenforceable, the rest stays in force.

No waiver. If we do not enforce a right straight away, we do not lose it.

Third parties. No one other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

16. Governing law

These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you have as a consumer in your country of residence.

17. Contact

Questions about these Terms can be sent to hello@mcpform.io. Privacy questions go to privacy@mcpform.io.
